Introduction

CAT Logistika Tereti d.o.o., a Limited Liability Company, with share capital of 20.000,00 euros, having its head office located at Kovinska Ulica 28, 10000 Zagreb, Croatia, registered under commercial number 977 763 67753, and represented by Gaxan CASTANOS, in his quality of Managing Director (hereinafter “CAT Logistika Tereti d.o.o.”).

This Privacy Policy provides information about the protection of your personal data by CAT Logistika Tereti d.o.o. Its aim is to inform you of the use of your personal data, the purpose of its use and its share by CAT Logistika Tereti d.o.o., the duration of the storage of your personal data and how you can exercise your rights (hereafter the “Policy”).

As the data controller, CAT Logistika Tereti d.o.o. is responsible for collecting and processing your personal data (hereinafter referred to as “Personal Data”) in the context of the Internet user’s use of its website “www.groupecat.hr” (hereinafter referred to as the “Website”), in accordance with this Policy, the relevant data protection laws and the General Data Protection Regulation (“GDPR”).

  1. What Personal Data are processed?

CAT Logistika Tereti d.o.o. only collects and uses your Personal Data when it’s necessary with the functionalities offered through CAT Logistika Tereti d.o.o.’s Website, to any user connecting to the Website. CAT Logistika Tereti d.o.o. doesn’t collect unnecessary Personal Data and will process the Personal Data of the user only in the manner specified in this Policy.

CAT Logistika Tereti d.o.o. is required to collect the different categories of Personal Data concerning the user, directly from him, and the following:

  • Identification information (such as full name, IP address)
  • Contact information (such as postal address, email address, phone number)
  • Connection and tracking data (such as timestamp, cookies, connection to online services)
  • Data relating to habits and preferences of the user (such as data relating to your interactions with CAT Logistika Tereti d.o.o. such as navigation on the Website).
  • What are the consequences of not providing your Personal Data?

The provision of Personal Data collected on the Website, for the purposes set out below, is mandatory; such Personal Data being essential for these purposes. Failure to provide Personal Data by the user makes it impossible to process his request.

CAT Logistika Tereti d.o.o. collects and uses your Personal Data:

  • To respond to requests for information sent by the user
  • To occasionally send by e-mail, information of commercial nature that CAT Logistika Tereti d.o.o. considers to be beneficial for the user and suited to his legitimate interest (i.e for promoting and marketing our services, and for improving our services by conducting survey and gathering insights);
  • To process the spontaneous job application request made by the user;
  • To respond to any requests to exercise rights in relation to the Personal Data;
  • For the functionalities offered by “cookies”. Regarding the “cookie” management policy followed by CAT Logistika Tereti d.o.o., please refer to article 4.

The processing of the user’s Personal Data is carried out on the basis of the user’s consent, for compliance by CAT Logistika Tereti d.o.o. with its legal obligations or to serve the legitimate interest of CAT Logistika Tereti d.o.o., in particular for purposes of proof and defense of its rights.

No automated decisions-making is carried out by CAT Logistika Tereti d.o.o. on the basis of Personal Data.

  • Handling inquiries and managing client relationships

When you contact us for new business, sponsorship, media inquiries, events, or anything else via e-mail or web form, we will first determine the nature of the inquiry. In case it contains personal information, we will process this information in the manner prescribed by this Policy for a particular type of Personal Data, or manner which is prescribed by law. We process your Personal Data based on our legitimate interest, contractual obligation, or based on our legal obligations.

We will keep your Personal Data for the period necessary to resolve your inquiry, for the duration of our contractual relationship, for the period we are legally obliged to keep data about our business partners or other business-related contacts, but we may also keep your contact data to contact you for possible follow-up projects and offers or ask for your feedback, on the basis of our legitimate interest.

  • For promoting and marketing our services

When you enter your email address in the form to receive our newsletter, or you give your consent that we can deliver you specific content regarding the topic you are interested in, your email address will be used only for that specific purpose.  You can unsubscribe via the link at the bottom of each newsletter or by sending us an e-mail at lchr_dpo@groupecat.com. Such activities are provided based on your explicit consent, and you can opt-out freely, without impact on previous processing, at any time using the option at the bottom of every material delivered.

We provide books, whitepapers, and other downloadable content on our website. Before downloading such content, you will be asked to provide your personal information. We will use your e-mail address to send requested resources and to solicit feedback. We may use your e-mail based on a legitimate interest to contact you for similar content and for the purposes of direct marketing based on our legitimate interest.

We may use your data for promotion and marketing of our services for the period we’ve got your consent to do so and for the purposes of direct marketing and purposes based on our legitimate interest until you request us to remove you from our mailing list and for an additional 5 years so that any potential disputes or issues may be resolved in this period.

  • For improving our services by conducting survey and gathering insights

We may contact you to provide feedback about your experience with our Website, products and/or services in the form of online surveys to improve the quality of our services and to monitor the quality of our services, all based on our legitimate interest. We also may analyze your activity and interactions within our Website to improve your user experience or to improve our services.

The Website uses Google Analytics cookies to collect standard internet log information and details of user behavior patterns, to track and report Website traffic. Google Analytics allows website owners and applications to better understand their users’ behavior. This tool can use cookies to collect information and generate statistical reports of Website use without individual users being identified personally by Google. Google Analytics uses cookies, which are stored on people computers, and the data generated by the cookie about people visits is usually sent and stored on a Google server in the USA.

By accessing the Website, User consents to the installation of Google cookies to access, log, and view the information stored on the terminal.

Based on our legitimate interest and, when legally required, based on your consent, we may use cookies, log files, and other technologies to collect personal information in a manner described in article 4.

  • To whom may your Personal Data be disclosed?

CAT Logistika Tereti d.o.o. communicates Personal Data only to:

  • Concerning the “contact form”: the Communication department, the Human Resources and, the Sales department impacted by the request;
  • Concerning “spontaneous job application”: the Human Resources and Communication Department, the staff in charge of recruitment within CAT Logistika Tereti d.o.o. or with the Groupe CAT;
  • Service providers and subcontractors performing services on its behalf (for example, for hosting the Website, for the provision of services related to the operation or maintenance of Website, provision of services relating to the sending of commercial offers);
  • Judicial authorities or state agencies mediators, public organization, upon request and within limits of what is permitted by regulation; and
  • Regulated professions such as lawyers.
  • Transfer of Personal Data outside the European Economic Area

CAT Logistika Tereti d.o.o. may transfer Personal Data outside the European Economic Area (EEA) for permitted purposes described above. As a result, Personal Data may be stored or hosted on servers located in third countries that do not offer the same level of protection as that offered by European Union legislation. In such circumstances, CAT Logistika Tereti d.o.o. will ensure that any transfer of Personal Data is subject to sufficient or appropriate safeguards in accordance with data protection laws and the GDPR.

Wherever possible, Personal Data is hosted on servers located in the EEA. However, as some of CAT Logistika Tereti d.o.o. service providers subcontractors are located in countries outside the EEA, Personal Data concerning  the user is processed in these countries. Some of these countries may have different regulations on Personal Data from those of the European Union. In such case, CAT Logistika Tereti d.o.o. takes particular care to ensure that the transfer is carried out in accordance with the applicable regulations and implements guarantees ensuring a level protection of privacy and fundamental rights equivalent to that offered by the European Union (in particular by using the European Commission’s Standard Contractual Clauses).

  • How long is your Personal Data kept?

The Personal Data declared by the user in the so-called “contact form” are kept for a period of 5 years.

The Personal Data posted by the user in the so-called “unsolicited application” form and the Curriculum Vitae are kept for a period of 5 years. After this period, the Personal Data declared by the user in the so-called “unsolicited application” form and the Curriculum Vitae are destroyed.

  • What are you rights and how can you exercise them?

In accordance with the applicable regulations, user who have provided CAT Logistika Tereti d.o.o. with Personal Data within the framework of the Website shall have the following rights:

  • Right of access (GDPR article 15): user may obtain information on the processing of his Personal Data and a copy of said Personal Data.
  • Right of rectification (GDPR article 16): user can request that his Personal Data be modified when he considers that this Personal Data is inaccurate or incomplete.
  • Right to erasure (GDPR article 17): user may request the deletion of his Personal Data, to the extent permitted by law.
  • Right to limitation of processing (GDPR article 18): user may request the limitation of the processing of his Personal Data, within the limits permitted by law.
  • Right to object (GDPR article 21): user may object to the processing of his Personal Data, for reasons related to his particular situation.
  • Right to withdraw consent: Insofar as the user gives his consent to the processing of his Personal Data, within the framework of the Website, user has the right to withdraw his consent at any time.
  • Right to portability (GDPR article 20): In the cases provided for by law, user has the right to have his Personal Data provided to CAT Logistika Tereti d.o.o. returned to him or, where technically possible, transferred to a third party that he has designated to CAT Logistika Tereti d.o.o.

In all cases, a scan or photocopy of the user’s national identity card must be provided for identification purposes.

  • Protective measures and confidentiality

CAT Logistika Tereti d.o.o. acknowledges  the importance of protecting privacy and takes all necessary technical and organisational measures and precautions to preserve the confidentiality and security of Personal Data. CAT Logistika Tereti d.o.o. shall do his best to protect Personal Data from alteration, disclosure, destruction or unauthorized access.

  1. Complaints to the competent supervisory authority

CAT Logistika Tereti d.o.o. undertakes to process Personal Data in accordance with this Policy and with the laws and regulations in force on data protection. However, if the user wishes to lodge a complaint regarding processing his Personal Data or if he is not satisfied with the way in which CAT Logistika Tereti d.o.o. has processed it, the user has the right to lodge a complaint within the Croatian Personal Data Protection Agency (AZOP).   1. Amendments to this Policy

CAT Logistika Tereti d.o.o. may be required to update this Policy on regular basis, in particular to take account of technological developments. CAT Logistika Tereti d.o.o. invites all users to regularly check the latest version of this Policy on the Website. CAT Logistika Tereti d.o.o. shall inform users of any substantial changes to this Policy via the Website.
